1. General provisions
1.1. Scope
These terms and conditions apply to all quotes, orders, agreements, deliveries, installations and services of CASA CONNECT. By accepting a quote or placing an order, the customer declares to have read and accepted these terms.
1.2. Consumers and business customers
A "consumer" is any natural person acting for purposes outside their trade, business, craft or profession. Provisions that expressly apply to consumers take precedence over the general provisions. Nothing in these terms affects the mandatory rights consumers enjoy under the Belgian Code of Economic Law and the Civil Code.
1.3. Deviations
Deviations from these terms are only valid if agreed in writing. Any general terms of the customer do not apply unless CASA CONNECT has expressly accepted them in writing.
1.4. Severability
The invalidity of any provision does not affect the validity of the remaining provisions. The parties will replace the invalid provision with a valid one that comes as close as possible to the original intent.
2. Quotes and prices
2.1. Quotes from CASA CONNECT are without obligation and valid for 15 calendar days from the quote date, unless stated otherwise. An agreement is concluded upon written (including email) acceptance of the quote by the customer.
2.2. Prices for consumers are always stated including VAT and all other taxes. Prices for business customers are exclusive of VAT. Any shipping and transport costs are stated separately in the quote.
2.3. Discounts and promotions are only valid while stocks last or during the stated period.
2.4. In case of demonstrable increases in cost factors (materials, energy, transport) after the agreement is concluded, CASA CONNECT may adjust the price for the part not yet performed. For consumers, a price adjustment may only be applied with their express consent; failing that, the consumer may terminate the agreement free of charge for the part not yet performed.
2.5. Orders from customers with whom a dispute or unpaid invoices are pending may be refused.
3. Risk and retention of title
3.1. The risk of loss of or damage to the goods passes to the customer upon delivery. For consumers, the risk passes at the moment they, or a third party designated by them, physically take possession of the goods.
3.2. Delivered goods remain the property of CASA CONNECT until full payment of the price, including any costs and interest.
3.3. Until title has passed, the customer keeps the goods in good condition and ensures appropriate insurance.
4. Delivery and installation
4.1. Delivery times
4.1.1. Delivery times are indicative and stated in the quote. Average times:
- Products in stock: 3 to 7 working days after payment of the deposit
- Products to order: 2 to 6 weeks after payment of the deposit
- Installation work: by arrangement, depending on planning and complexity
- Custom projects: according to the project schedule in the quote
4.1.2. Exceeding an indicative delivery time does not entitle the customer to compensation. If the delay exceeds 30 calendar days, the customer may give CASA CONNECT written notice to deliver within a reasonable additional period; if delivery still does not take place, the customer may terminate the agreement free of charge for the undelivered part and any amounts already paid for that part will be refunded.
4.1.3. CASA CONNECT informs the customer of any delay and the new expected delivery date as soon as possible.
4.2. Delivery may take place in parts. Each delivered part may be invoiced separately.
4.3. The customer ensures that:
- the location is accessible on the agreed date;
- power and internet connections are available where required for the installation;
- delivery and installation can take place without interruption;
- any agreed preparatory work has been completed.
If the installation cannot go ahead on the agreed date due to the customer, travel costs and lost working time may be charged at the hourly rate stated in the quote.
4.4. Cancellation by the customer
Without prejudice to the consumer's right of withdrawal (section 5), the following fees apply to cancellation after acceptance of the quote:
- before materials have been ordered from the supplier: 10% of the total price as a fixed fee for the preparation carried out;
- after materials have been ordered from the supplier: the actual cost of the ordered, non-cancellable materials plus 10% administration costs.
The customer may claim equivalent compensation from CASA CONNECT if CASA CONNECT cancels the agreement for reasons not attributable to the customer or to force majeure.
5. Right of withdrawal for consumers
5.1. Where the agreement is concluded at a distance (for example by email or via the website) or away from CASA CONNECT's business premises (for example at the consumer's home), the consumer has the right to withdraw from the agreement without giving any reason within 14 calendar days. This period starts:
- for services (installation, configuration, aftercare): on the day the agreement is concluded;
- for goods: on the day the consumer, or a third party designated by them, physically takes possession of the goods.
5.2. To exercise the right of withdrawal, the consumer informs CASA CONNECT of their decision by an unequivocal statement (for example by email to info@casaconnect.be or by post). The consumer may use the model form at the end of these terms, but is not obliged to. The deadline is met if the notice is sent before the 14-day period expires.
5.3. In case of withdrawal, CASA CONNECT refunds all payments received from the consumer, including any delivery costs, within 14 days of the day on which CASA CONNECT was informed of the withdrawal, using the same means of payment the consumer used, unless agreed otherwise. For goods, CASA CONNECT may withhold the refund until the goods have been received or the consumer has supplied evidence of having sent them back.
5.4. The consumer returns the goods without undue delay and no later than 14 days after communicating the withdrawal, to Herentalsebaan 140, 2100 Antwerp. The direct cost of returning the goods is borne by the consumer. The consumer is liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
5.5. If the consumer wishes the performance of services to begin during the withdrawal period, they make an express request to that effect (for example by ticking this in the quote). If the consumer subsequently withdraws, they pay an amount proportionate to what has been performed at the time of withdrawal.
5.6. The right of withdrawal does not apply to:
- services that have been fully performed, where performance began with the consumer's prior express consent and the consumer acknowledged losing the right of withdrawal once the service is fully performed;
- goods made to the consumer's specifications or clearly personalised (custom work);
- urgent repair or maintenance work for which the consumer expressly requested a visit from CASA CONNECT;
- sealed software or firmware that has been unsealed after delivery.
6. Invoicing and payment
6.1. Invoices are payable within 14 calendar days of the invoice date, unless agreed otherwise.
6.2. Upon acceptance of a quote, a deposit of 40% of the total price may be invoiced. Materials may be invoiced on delivery; installation work on completion.
6.3. Late payment by consumers
In case of non-payment on the due date, the consumer first receives a free reminder. Only if payment is still outstanding after a period of 14 calendar days, starting on the third working day after the reminder is sent (or the day after sending in case of email), are the following amounts due, in accordance with Book XIX of the Belgian Code of Economic Law:
- default interest at the reference rate of the Act of 2 August 2002 on combating late payment in commercial transactions, plus 8 percentage points;
- a fixed compensation of: €20 where the outstanding balance is €150 or less; €30 plus 10% of the amount between €150.01 and €500 where the balance is between €150.01 and €500; €65 plus 5% of the amount above €500, capped at €2,000, where the balance exceeds €500.
6.4. Late payment by business customers
In case of non-payment on the due date, the business customer owes, by operation of law and without notice of default, default interest in accordance with the Act of 2 August 2002, as well as a fixed compensation of 10% of the outstanding amount with a minimum of €175, without prejudice to CASA CONNECT's right to claim the actual recovery costs.
6.5. Disputes regarding an invoice must be notified in writing, with reasons, within 14 calendar days of the invoice date.
7. Warranty and complaints
7.1. Legal guarantee for consumers
Consumers benefit from the legal guarantee of two years for any lack of conformity of delivered goods, counting from delivery (Articles 1649bis et seq. of the old Belgian Civil Code). For goods with digital elements, the guarantee also covers the digital content or service needed for the goods to function. For second-hand goods the guarantee period is one year, where this is expressly stated in the quote. The consumer preferably reports a lack of conformity as soon as possible and at the latest within two months of discovering it.
7.2. Warranty on installation work
Installation work carried out by CASA CONNECT is covered by a warranty of two years from completion against defects attributable to faulty workmanship. This warranty applies without prejudice to the legal guarantee and to any manufacturer's warranty, which continues to apply separately.
7.3. What the warranty covers
- manufacturing and material defects in delivered products;
- defects resulting from faulty installation by CASA CONNECT.
7.4. What the warranty does not cover
- normal wear and tear and consumables (batteries, bulbs, filters);
- damage caused by improper, careless or non-compliant use;
- damage caused by modifications or repairs by the customer or third parties;
- damage caused by external causes such as fire, water, lightning, power surges or force majeure;
- malfunctions caused by software updates or changes to third-party services (e.g. manufacturers' cloud services or apps) over which CASA CONNECT has no control.
7.5. Handling
In case of a justified complaint, the consumer is entitled, in accordance with the law, first to free repair or replacement within a reasonable time. If this is impossible or disproportionate, or if repair or replacement does not take place within a reasonable time, the consumer is entitled to an appropriate price reduction or to termination of the agreement. For business customers, CASA CONNECT chooses at its discretion between repair, replacement or a credit note.
7.6. Visible defects and damage on delivery are preferably reported by the customer within 7 calendar days of delivery so they can be readily established. For consumers this does not limit the legal guarantee.
8. Liability
8.1. CASA CONNECT is liable for damage that is the direct result of a breach attributable to it. Towards business customers, this liability is limited to the invoice amount of the agreement concerned.
8.2. CASA CONNECT is not liable for indirect damage, consequential damage or loss of profit, except in case of wilful misconduct or gross negligence.
8.3. Nothing in these terms limits CASA CONNECT's liability for wilful misconduct, gross negligence, death or personal injury, nor the mandatory rights of the consumer.
8.4. CASA CONNECT is not liable for damage caused by third parties, by a defective internet connection or power supply at the customer's premises, by equipment not supplied by CASA CONNECT, or by changes to third-party services.
8.5. CASA CONNECT holds professional liability insurance. The insurance certificate is available on request.
9. Force majeure
9.1. In case of force majeure (including, without limitation: natural disasters, fire, epidemics, strikes, supply problems at manufacturers, network outages), performance of the agreement is suspended for the duration of the force majeure.
9.2. If the force majeure lasts longer than 90 calendar days, either party may terminate the agreement in writing for the part not yet performed, without compensation. Amounts already paid for goods or services not delivered will be refunded.
10. Aftercare plans (subscriptions)
10.1. Aftercare plans are entered into for a period of one year and invoiced monthly or annually, as chosen by the customer. The content of each plan is described on the website and in the quote.
10.2. After the initial period, the plan is tacitly renewed for an indefinite period. After renewal, the customer may cancel the plan at any time free of charge with a notice period of one month, by email to info@casaconnect.be. In case of annual payment, the unused part is refunded pro rata.
10.3. CASA CONNECT may change the content or price of a plan subject to at least two months' written notice. In that case the customer may terminate the plan free of charge before the change takes effect.
11. Termination
11.1. Either party may terminate the agreement in case of a material breach by the other party that is not remedied within 14 calendar days of a written notice of default.
11.2. In case of termination for non-payment, all outstanding amounts become immediately due, subject to section 6.
12. Intellectual property
12.1. All intellectual property rights in configurations, programming, automation scenes, documentation and designs created by CASA CONNECT remain with CASA CONNECT. The customer obtains a non-exclusive, non-transferable right of use for their own installation, for an indefinite period and at no additional cost.
12.2. Third-party software and firmware (manufacturers, open-source projects) remain subject to the licence terms of the respective rights holders.
13. Privacy and data processing
13.1. CASA CONNECT processes personal data in accordance with the General Data Protection Regulation (GDPR). How this is done, the retention periods and the customer's rights are described in the privacy policy.
13.2. For aftercare plans with remote access, CASA CONNECT only processes the technical data needed to manage and secure the installation. Remote access takes place exclusively with the customer's consent and via a secured connection.
14. Complaints and dispute resolution
14.1. Internal complaints procedure
The customer may file a complaint via info@casaconnect.be, by phone at +32 456 77 37 64 or by post to Herentalsebaan 140, 2100 Antwerp, stating their name and contact details, invoice or quote number, a clear description of the complaint and the desired solution. CASA CONNECT acknowledges receipt and handles the complaint within 14 calendar days.
14.2. Out-of-court dispute resolution
If no solution can be reached with CASA CONNECT, consumers may turn to the Belgian Consumer Mediation Service (Consumentenombudsdienst), North Gate II, Koning Albert II-laan 8 box 1, 1000 Brussels – consumentenombudsdienst.be. CASA CONNECT undertakes to cooperate in good faith in any mediation procedure.
14.3. Applicable law and competent court
These terms and all agreements are governed by Belgian law. Disputes are submitted to the courts of the judicial district of Antwerp. For consumers, jurisdiction is determined by Article 624 of the Belgian Judicial Code, so that they may always bring proceedings before the court of their place of residence.
